MacOnLine Acceptable Use Policy
1. Introduction
1.1 This Acceptable Use Policy applies to all
customers of MacOL. This AUP provides a general
understanding of MacOL 's policy on the Acceptable Use of
Internet services. It is designed to help protect our
service, our customers, and the Internet community from
irresponsible or illegal activities. MacOnLine expects
that common sense and good judgment will guide all of our
subscriber's activities on the Internet.
1.2 MacOL will report to law enforcement authorities
any actions, which may be considered illegal, as well as
any reports it receives of such conduct. When requested,
MacOnLine will cooperate fully with law enforcement
agencies in any investigation of alleged illegal activity
on the Internet.
1.3 MacOL does not monitor the activity of accounts
except for measurements of system utilization ( maximum
200 hours per account per month) and billing records.
However, in our efforts to promote good citizenship
within the Internet community, if we become aware of
inappropriate use of any MacOL service, we will respond.
1.4 If a MacOL account is used to violate the MAUP, we
reserve the right to terminate service without notice.
Our preferred course of action would be to advise the
account owner of the inappropriate behavior and
corrective action necessary. However, flagrant violations
of the MAUP will result in immediate termination of
service.
1.5 In the event that an account is temporarily
inactivated as a result of any prohibited activities, the
account may be subject to reactivation charges and/or
deposit requirements to be determined by MacOL. Customer
understands that MacOL has the right to terminate any
account for any reason that MacOL interprets as an abuse
of the account. Customer's sole remedy is to receive a
refund for prepaid but unused whole months of
service.
1.6 MacOnLine members are responsible for all charges
(i.e., telephone) associated with connecting to Networks
through an available access number. Please check with
your phone carrier to ensure the selected number is
considered a local call.
1.7 All communication between
MacOL and it customers, members will be electronic
communication, i.e., by email. MacOL is an Internet
company and refrains from using hard copy and the US mail
system unless absolutely necessary and never for mass
communication.
2. Policies for Premium consumer, personal
accounts:
2.1. Only the authorized owners of the accounts may
use MacOL accounts except where specifically authorized
by MacOL system administrators. Revealing your account
password to others or allowing use of your account by
others is prohibited. At no time can there be
simultaneous use of the same account ID and password
combination.
2.1.1 MacOL accounts are to be used as personal,
individual, consumer accounts only. Commercial / business
accounts are not available under .
2.2. MacOL accounts and services may be used for
lawful purposes only. Use of a MacOL account or service
in an illegal manner is ground for immediate termination
of the account. Activities which are prohibited as
potentially illegal include, but are not limited to:
2.2.1. Unauthorized copying of copyrighted material
without the consent of the copyright holder.
2.2.2 Exportation of software or technical information
in violation of U.S. export control laws.
2.2.3. Making fraudulent offers of items, products, or
services originating from your account is prohibited.
2.2.4. Threatening bodily harm or property damage to
individuals or groups. (Email harassment is discussed in
further detail in the Email section of the AUP).
2.3. Use of a MacOL account to gain passwords,
encryption codes, or attempt to alter or destroy data
belonging to MacOL or another user on any computer
network is grounds for immediate termination. This
includes storing illegally obtained information of any
sort.
2.4. Distribution of malicious software, which
contributes to or assists in "mail-bombing" or
"spamming", is strictly forbidden.
2a. Policies for the Commercial Accounts
account:
2a.1. All policies govern the Business account also.
2a.2 Business accounts include an extra two email
accounts for a total of three. There is no limit to the
size and number of emails that can be sent or received
keeping in mind Spamming is prohibited.
2a.3 Website traffic allowances is expanded to 2500
hits per month.
2a.4 Toll free tech support calls
2a.5.Web space provided at no cost is 25 Mb
3. E-mail
The following Email-related actions are prohibited:
3.1. Sending unsolicited E-mail for the purpose of
advertising or soliciting, or using MacOL 's E-mail
address to collect responses from unsolicited E-mail.
3.2. Attempting to impersonate any person, using
forged headers or other identifying information.
3.3. Harassing others by "mail-bombing" or "spamming",
which constitutes sending of the same or substantially
similar unsolicited electronic mail messages to a large
number of recipients, or more than ten (10) similar mail
messages to the same Email address or 12 Mb of data to a
newsgroup.
3.4 Sending any email message and/or attachment in
excess of 2 Mb.
3.5. Using an Email box exclusively as a storage space
for data.
3.6. Sending threatening or harassing E-mail (for
example, making terrorist threats, or threatening
physical injury or damage to persons or property).
Not every "flame" message or angry exchange of Email
can automatically be considered harassment. MacOL is not
responsible for the content or tone of any email or other
transmissions of the subscribers to its Service or other
parties using the Internet, and subscribers or others
should not expect that MacOnLine will attempt to mediate
or otherwise become involved in any particular
disagreement or dispute between Internet users. However,
MacOL will cooperate with appropriate law enforcement
agencies involved in investigating instances that may be
reported to such authorities by subscribers or other
users who believe they are being subjected to potentially
unlawful harassment.
4. Home Pages
4.1 MacOL provides at no additional charge a 10
Megabyte server space for each individual account to
publish a personal (noncommercial) home page. MacOL
reserves the right to censor inappropriate adult content
web sites. Extreme violence and or mutilation in any and
all forms are inappropriate. Instruction, recipes,
directions, for the use or production of explosives or
narcotics is expressly forbidden.
4.2 MacOL provides this 10 Mb free web space for
the personal enjoyment of our customers. Business or
Commercial websites must be hosted under the provisions
of a commercial web hosting agreement. No commercial or
business sites will be permitted in this free 10 Mb
space. (Definition: If you are selling any product or
service or information, if you are conducting any
commerce, if you are promoting any business, service or
product including on site advertising then is it
prohibited. If you are receiving any compensation for the
promotion, endorsement, and/or advertising of any product
or service it is prohibited.)
4.3 Any member in violation will be warned by email
once and if the prohibited site is not corrected with in
5 business days it will be terminated.
5. News (Usenet) As of July 14, 2007 MacOL will no
longer provide the free service of New Groups by USENet.
As a free service Usenet access was provided to
customers of MacOL. This service may be terminated at any
time by MacOL.
6. Internet Relay Chat (IRC)
The use of IRC bots is prohibited, as is the violation
of any accepted policies on IRC servers. If MacOL is
banned from a server, the offending account will be
terminated.
7. Financial
7.1. After the first month of service, if you wish to
cancel your Internet account you will charged for the
full second month and each month thereafter. The first
month is prorated, thereafter there is no proration of
any account. [Example: You sign on June 29 and you
cancel July 2, you will be billed for 2 days in
June and for the month of July, thus your total
bill for service would on your first and final
bill.]
7.2. Your account will be billed on or around the
second (2nd) day of each month. Unless other arrangements
are made with the Accounting Department. Billing is done
for advance pay check customers only and all notices of
billing is done by e-mail. All accounts unpaid by the
23rd of the month will be considered delinquent and will
be subject to suspension.
7.3 Although payment by check is no longer (as of Dec
29, 2007) accepted by Maconline, previous checking
account customers who become delinquent will be given the
option of updating their method of payment to credit
card, debit card, or advance pay only. Once suspended,
checking account customer accounts will not be
reactivated without credit card.
7.4. For any reason your credit card is declined.
MacOnLine will place a temporary hold on the account
until; the Accounting Department receives payment in
full. If payment is not received within seven days your
account will be temporarily inactive. Appropriate action
will be taken to collect the debt plus a bookkeeping fee
.
7.5. After fourteen days your account will be
suspended any email on the server will not be accessible.
7.6. If you are paying by credit card all refunds will
be credited to your card account by MacOL within six to
eight weeks from the day you canceled service.
7.7. Sharing ( maximum 200 hours per
account per month) accounts with anyone other than
an immediate family member living at the same address,
under the same roof, or reselling service without express
written consent from MacOL, or offering any public
information service, such as running a web server or FTP
server, is prohibited. Repeated attempts simultaneous
sign on of any two persons using the same user name and
password is prohibited and will result in immediate
cancellation of account. Untimely payment of any and all
amounts due may result in account cancellation and
additional charges.
7.8 Returned checks and/or declined credit cards will.
8. Refunds or credit for system outages.
8.1 MacOnLine will credit to any customer in good
standing the amount of 64¢ per 24 hour day of total
system outage due to server malfunction or any problems
within the control of MacOnLine. National, international
or backbone outages from UUnet, AT&T, Atel, or Qwest
are beyond the control of MacOnLine. To receive your
refund in the instance of a system outage due to down
servers or other reasons within the control of MacOnLine
please use the refund request form at
http://www.macol.com/refundrequestform.html.

9. Cancellation of accounts is accepted
at any time prior to the last 72 hours in the month by
emailing beginin@gmail.com.
After the first month of service, accounts are NOT
prorated and actual cancellation of accounts occurs on a
business day during (or close to) the last 72 hours of
the month in order for the customer to get full value for
the month and to allow MacOnLine enough time to guarantee
you are not charged for an additional month. Past due
accounts will not be canceled until they are brought
current within the time frame stated above.
9.1 Cancellations and/or network/account modifications
can be accepted only by email. MacOnLine reservers 72
hours at the end of each month to cancel accounts and
make sure they are not automatically charged for the next
month. To guarantee your account is canceled at the end
of the billing period please send in your cancellation
request at least 72 hours prior to the end of the month.
Please refer to 7.1 for cancellation and payment
information.
9.2 MacOnLine does not offer the service of forwarding
of email of a canceled account.
9.3 Upon Cancellation a customer will be notified that
the account will not be prorated and will remain open
through the remainder of the calendar month. The customer
may use this time to arrange for notifying his/her
correspondence of a new address. All cancellations occur
at the discretion of MacOnLine during ( or close to) the
last 72 hours for the month.
9.4 As a second alternative the customer may purchase
the macol.net email address for. This
account does not include toll free tech support. All tech
issues should be handled by email. Tech calls will be
billed at per call.
9.5 No account with an outstanding balance will be
allowed to canceled until the balance is paid in full.
There will be NO exceptions.
10. Indemnification. I agree to defend, indemnify and
hold MacOnLine and its affiliates harmless from any and
all liabilities, costs, and expenses, including
reasonable attorneys' fees, related to or arising from ,
any violation of this agreement by me or those who access
the services through my account, or the use of the
services or the Internet and the placement or
transmission of any message, information, software, audio
files or other materials on the Internet by me or by
those who have access to the services through my account.
11. Termination. I understand that MacOnLine reserves
the right to terminate my account at any time, for any
reason, including, but not limited to, my failure to
abide by the terms of this agreement or my failure to pay
any fees or charges when due. If my account is
inactivated, I may be required to pay reconnect charges
and a prepaid deposit in order to reactivate my account.
If my account includes space on MacOnLine's server,
anything stored in this space will be deleted upon
inactivation. I understand that violation of certain
generally accepted guidelines on Internet usage, such as
restrictions on mass e-mailing and mass advertising, or
posting to inappropriate newsgroups, may cause severe
operating difficulties for MacOnLine, and would be a
likely cause for termination of my account. More detail
of violations can be found in the MacOnLine Policy on
Appropriate Use. I agree to abide at all times by
MacOnLine's then-current Policy on Appropriate Use as
made available via a link on the MacOnLine home page at
http://www.MacOL.com/ and by any other policies posted on
the MacOnLine web site.
12. Law and Jurisdiction. I understand and agree the
laws of the State of Alabama govern these Terms of
Service and my MacOnLine account. I expressly agree that
exclusive jurisdiction for any claim or dispute with
MacOnLine or relating in any way to my account or my use
of MacOnLine resides in the courts of Alabama. I further
agree and expressly consent to the exercise of personal
jurisdiction in the courts of Alabama in connection with
any such dispute, including any claim involving MacOnLine
or its affiliates, subsidiaries, employees, contractors,
officers, or directors.
